13. Shipment Risk, Liability & Limitation of Responsibility

13.1 Role of Sera Logistics

Sera Logistics acts as a logistics facilitator and intermediary between customers and third-party carriers, transporters, and service providers.

We do not operate as a carrier unless explicitly stated in writing.

13.2 Transfer of Risk

All shipments are transported at the customer’s risk, unless otherwise agreed in writing.

Risk transfers:

  • At pickup from the consignor, or
  • As per agreed Incoterms or contract terms

13.3 Limitation of Liability

To the maximum extent permitted by law:

  • Sera Logistics shall not be liable for:
    • Loss or damage to goods
    • Delay in delivery
    • Theft, fire, accident, or natural disasters
    • Acts of third-party carriers

 

  • In any case, liability (if applicable) shall be limited to:
    • The lower of:
      • Actual proven loss, OR
      • Freight charges paid for that shipment

13.4 No Liability for Force Majeure

Sera Logistics Private Limited shall not be responsible for delays or failures caused by events beyond reasonable control, including but not limited to:

13.5 Packaging Responsibility

The customer is solely responsible for:

13.6 Prohibited & Restricted Goods

Customers must not ship prohibited, hazardous, or illegal goods without proper declaration and documentation.

Sera Logistics shall not be liable for:

  • Seizure by authorities
  • Fines or penalties
  • Legal consequences arising from such shipments

13.7 Insurance

  • Shipment insurance is not included by default
  • Customers are strongly advised to obtain insurance

If insurance is requested:

13.8 Claims Procedure

Any claim for loss or damage must:

  • Be reported within 24–48 hours of delivery
